Ласка занимают видное место в контексте философ-ско-правовых дискуссий рубежа XIX – начала XX в., заключающихся в противостоя-нии правового позитивизма и неокантианства. Реконструкция и анализ философии права неокантианского философа позволяют существенно уточнить и дополнить со-временные представления о состоянии и развитии философско-правовой мысли в Германии в начале XX в. Doctrines of the philosophy of right took a special place in philosophers’ investigations in Ger-man universities at the turn of the 20th century. This was mainly due to the formation of the science of right as an independent discipline in the 19th century. The basis of discussions in the sphere of the philosophy of right was the questions of the methodology of the new science of right, the correlation of the empirical and philosophical science of right. The ideas of the Neo-Kantian philosopher Emil Lask take a prominent place in the context of discussions about right in the late 19th and early 20th centu-ries, in particular, in opposition to practice-oriented legal positivism and Neo-Kantianism. In my inves-tigation I try to reconstruct Lask’s docrine of right set out in his dissertation Philosophy of Right (1905), in which Lask seeks to overcome the extremes philosophies of right in the spirit of Kantianism and Hegelianism. This opportunity is given by an understanding of the philosophy of right as a doc-trine of the type of attribution to value, as well as the formulation of a special understanding of the “social” type of attribution to value, combining and individualizing Kant’s ethics and Hegel’s social teachings. A necessary condition for the methodology of the new doctrine of right is, according to Lask, the approval of the pre-scientific stage of knowledge. The material of cultural sciences, in par-ticular, of right, is a unity of the material of reality and the material that appeared as a result of the pre-scientific formation of concepts. The methodology developed by Lask provided for the formation of a “logic of right” as a special value perspective for researching right. The science of right is the result of an epistemological analysis of legal experience. Through the perspective of the philosophy of values of Baden Neo-Kantianism, it serves as a response to the metaphysical doctrines of right and the develop-ing practice-oriented legal theories of the positivist sense in the second half of the 19th century. The “Philosophy of Right” is an organic stage in the formation of a mature philosophical project of Lask – the logic of philosophy.
